Severability.

All ordinances or parts of ordinances inconsistent herewith are hereby repealed. Each section, subsection, sentence, clause and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this Ordinance.

ORDINANCE

"AN ORDINANCE OF THE BOROUGH OF LAKEHURST, COUNTY OF OCEAN, STATE OF NEW JERSEY, VACATING ALL RIGHT, TITLE AND INTEREST OF AND

TO THE PUBLIC IN PORTIONS OF PINE STREET, IN THE BOROUGH OF LAKEHURST,

PURSUANT TO AND IN ACCORDANCE WITH N.J.S.A. 40:67-1 ET SEQ.

WHEREAS, the purpose of the within ordinance is to vacate all of the right, title, and interest of and to the public in all of those streets or portion of streets indicated and set forth in Section 1 of this Ordinance, pursuant to the provisions of N.J.S.A. 40:67-1, et seq.

SECTION 2. The portion of the street and roads to be vacated lie within the Borough of Lakehurst, County of Ocean, State of New Jersey and are described as follows:

PINE STREET All that Certain lot, tract, or parcel of land and premises, situated, lying and being in the Borough of Lakehurst, County of Ocean, State of New Jersey, and being more particularly described as follows: Beginning at a point in the Northerly right-of-way line of Pine Street (60' ROW), where it intersects with the Westerly right-of-way line of Lilac Street (60' ROW). Running thence from said Beginning:

1.) Southwardly, 60.0 feet more/less, that runs along the said Proposed Westerly

right-of-way line of Lilac Street, to a point in the Southerly right-of-way line

of Pine Street; thence 2.) Westwardly, 280.0 feet more/less, that runs along the said Southerly right-ofway

line of Pine Street, to a point the Southeasterly right-of-way line of New

Jersey Highway Route 70; thence 3.) Northeastwardly, 75.0 feet more/less, that runs along the said Southeasterly

right-of-way line of New Jersey State Highway Route 70, to a point in the

aforementioned Northerly right-of-way line of Pine Street; thence

4.) Eastwardly, 236.0 feet more/less, that runs along the said Northerly right-ofway

line of Pine Street, to the Point and Place of Beginning. Containing within said bounds of land 15,480 square feet and/or 0.36 Acres of Land (more or less)

WHEREAS, the Mayor and Borough Council are of the opinion that the referred to streets or portions of streets are no longer required for public use.

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Borough Council of the Borough of Lakehurst, County of Ocean, State of New Jersey, as follows:

SECTION 1. That except as is otherwise provided for herein, the Borough of Lakehurst does hereby vacate all public rights and interests, if any, in and to the aforesaid streets, which are described herein and aforesaid.

SECTION 2. That pursuant to P.L. 1985, Chapter 21, this ordinance shall not affect the right of any utility company or cable television company to locate or maintain any facilities within or around the above described premises; it is expressly reserved and excepted from vacation all rights and privileges then possessed by public utilities, as definedin R.S. 49:2- 13, and by any cable television company, as definedin the "Cable Television Act," P.L. 1972, c. 186, (C, 48:5A-1 et seq.), to maintain, repair and street. Highway, lane, alley, square, place or park, or any part thereof, to be vacated.

SECTION 3. That all ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. If any section, subsection, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining portions of the Ordinance. The Governing Body of the Borough hereby declares that is would have passed this Ordinance and each section or part thereof irrespective of the fact that any one or part thereof be declared invalid or unconstitutional.

SECTION 4. This Ordinance shall take effect immediately after final adoption and publication as declared by law. Hon. Timothy J. Borsetti Mayor
